Thomas products, when properly installed and under normal conditions of use, are warranted only to Thomas’ direct customers to be free from defects in material and workmanship at time of shipment. (Thomas does not warrant ballasts supplied with fluorescent units. The ballast manufacturer’s warranty, if any, must be consulted.) All warranty claims must be asserted within one year from date of receipt of the subject item; thereafter warranty claims will not be honored. Customer’s exclusive remedy for a warranty claim or otherwise shall be limited to repair or replacement of the subject product if it is shown to be defective in material or workmanship at time of shipment, and only if the claim is asserted during said one-year period. Thomas’ sole and maximum liability for a defective product shall never exceed the cost of the subject product. Except for such warranty and remedy as stated (and the express warranty of title), THOMAS DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICLULAR PURPOASE. In no case does the Thomas warranty and remedy extend to anybody other than Thomas direct customers unless Thomas packs a warranty card with the product, which states otherwise. Such unauthorized extensions of warranties by the customer shall remain customer’s responsibility.
